A California federal judge granted Finnegan client BMW a preliminary injunction requiring software startup Zync Inc. to seek a stay of its trade-secret case at the U.S. International Trade Commission, ruling that the dispute must be litigated in Germany pursuant to a forum-selection clause in the parties’ confidentiality agreement.
“BMW continues to deny each and every one of Zync’s substantive allegations, which will be resolved in the contractually agreed forum in Munich,” Finnegan partner Lionel Lavenue told MLex.
