Cara Regan works on patent and trade secret litigation at every stage, from the strategic decision to file a proceeding through appeal. Her experience includes district court and International Trade Commission (ITC) actions; post-grant challenges at the Patent Trial and Appeal Board (PTAB); and appeals at the U.S. Court of Appeals for the Federal Circuit, where she clerked.

Cara has been involved in district court proceedings, ITC investigations, contentious proceedings before the U.S. Patent and Trademark Office (USPTO), and appeals. She has experience with pre-suit due diligence, discovery, depositions, claim construction, summary judgment motions, Daubert motions, and post-trial briefing, as well as with managing related PTAB proceedings and pursuing appeals. She also assists clients in evaluating infringement risks and negotiating license agreements. Her technical expertise encompasses a wide range of technologies, including medical devices, software, mobile phones, laptops, automobiles, and consumer products.

Cara maintains a pro bono practice assisting with veteran's affairs, for which she has been recognized on the Capital Pro Bono Honor Roll.

  • Serves as an adjunct professor at George Mason University's Antonin Scalia Law School, 2020-present.
  • Served as a law clerk to the Honorable Kara F. Stoll of the U.S. Court of Appeals for the Federal Circuit, 2018-2019.

Experience

Promptu Systems Corporation v. Comcast Corporation

Obtained a $240 million jury verdict for client Promptu in a patent infringement lawsuit against Comcast. The jury found that Comcast willfully infringed Promptu’s patents covering voice recognition technology for TV.

NorthStar Systems LLC v. BMW et al.

Secured a royalty-free covenant not to sue from NorthStar for its present and future patent portfolio, which includes patents related to displaying navigation information on electronic maps, mobile devices selectively reporting GPS position information to others, and route-based communication planning architecture and wireless communication. This result was achieved after filing a declaratory judgement as well as IPRs on all claims of all asserted patents, leading to favorable institution decisions.

Finnegan represented Taiwan Semiconductor Manufacturing Company et al. in patent litigation involving semiconductor devices. The case settled.

In the Matter of Certain Power Inverters and Converters, Vehicles Containing the Same, and Components Thereof

BMW of North America, LLC and Bayerische Motoren Werke AG (collectively, “BMW”) earned a final determination rebuffing an International Trade Commission (ITC) complaint by Arigna Technology Limited (“Arigna”) aiming to ban the importation and sale of certain of BMW’s innovative mild-hybrid, hybrid, and all-electric SUVs and other vehicles.

United States Automobile Association v. Truist Bank

Represented Truist Bank in a patent litigation in the Eastern District of Texas against USAA, who asserted five patents directed to mobile deposit technologies. After asserting counterclaims on six patents and filing IPR petitions for each of USAA’s asserted patents, Finnegan’s strategy led to a favorable dismissal.

Represented LG Electronics in a patent infringement action against an non-practicing entity (NPE) seeking to exclude LG’s smart products with touch panels from the United States. The parties settled shortly before trial.
