Advanced Topics in U.S. Patent Law: New Strategies After Recent Cases

November 14, 2012

Taipei / Hsinchu, Taiwan

Finnegan’s Fei Han Foreign Legal Affairs Law Firm invites you to attend the next event of its program series.

Recent decisions from the U.S. Court of Appeals for the Federal Circuit and the U.S. Supreme Court have changed long-standing principles of patent law. These cases have raised many questions, including what non-infringement defenses are available and how to litigate them after the Akamai and McKesson decisions. Patentees also have to re-think how they prosecute patents or amend pending claims to strengthen their enforcement values. Many patentees also now have to reconsider what inventions are patentable in light of recent decisions like Prometheus and CLS Bank Int’l. We invite you all to discuss what the future holds for your litigation and prosecution strategies.

Please join our panelists Gary Ma and Ming Yang as they discuss:

  • My Customers Did Some of It: Joint Infringement, Induced Infringement, or None of the Above?
    • Akamai Tech. v. Limelight Networks, Federal Circuit
    • McKesson Tech. v. Epic Systems, Federal Circuit
    • Global-Tech v. SEB S.A., Supreme Court
  • Can I Still Patent It? – Recent Decisions About Patentable Subject Matter
    • What was patentable: the Gottschalk v. Benson, Parker v. Flook, and Diamond v. Diehr decisions
    • Recent decisions that changed the law
  • Bilski v. Kappos and Mayo Collaborative Serv. v. Prometheus Lab. Inc., U.S. Supreme Court
