Represented ADATA Technology in patent suit initiated by a non-practicing entity relating to dual-interface flash memory and external or USB memory devices. Developed unconventional arguments and defenses and secured a victory two months after filing of the complaint, resulting in the plaintiff’s voluntary dismissal.

Si-Flash Drives, LLC v. ADATA Technology (USA) Co., Ltd.

Defending ADATA against allegations of patent infringement directed to ADATA’s solid state drives. Case was stayed after ADATA filed two IPRs against all asserted patents, and both IPRs have been instituted by the Patent Trial and Appeal Board of the USPTO.

MemSmart Semiconductor Corp. v. AAC Technologies Pte. Ltd.
Represented AAC Technologies in patent suit initiated by a non-practicing entity relating to microstructures, microelectromechanical systems, and semiconductor microphones. Assisted with litigation and discovery in this multi-patent case, securing favorable settlement following attacks on the plaintiff’s infringement positions and patent validity.

Represented Innolux in suit for breach of IP indemnity against Applied Materials; developed offensive strategies to secure a favorable settlement and business resolution less than three months after filing of complaint.

Represented licensees and licensors in patent and trade secret license negotiations involving standard-essential patents (SEPs), semiconductor or integrated circuit (IC) patents, semiconductor process patents, factory management and automation patents, fitness equipment patents, telecommunication patents, computer networking patents, and other technologies in dozens of license negotiations; represented global companies in various IP license and cross license negotiations, presented and countered infringement assertions, formulated license terms and business arrangements, and prepared license agreements involving SEP patents, non-SEP patents, FRAND issues, MFN issues, audit provisions, arbitration mechanisms, etc. 

Acrox Technologies Co., Ltd. v. Best Buy Co., Inc.
Represented Acrox Technologies in patent infringement suit against Best Buy, Logitech, Inc., and Logitech International S.A. relating to iPad and tablet keyboards and accessories; developed both offensive and defensive strategies in a related counter suit, formulated arguments and legal positions, and led the parties’ negotiations that resulted in a favorable settlement and business resolution across all of the parties’ litigations.

Represented Realtek Semiconductor Corp. in a defensive patent suit relating to IEEE 802.11 (Wi-Fi) wireless technology. After a full trial, the investigation concluded with the ITC finding in Realtek’s favor on non-infringement, invalidity, and complainant’s failure to prove the existence of a domestic industry, and the Federal Circuit affirmed.
