Rehearing Petition in i4i Denied, Microsoft Certiorari Petition Likely

The U.S. Court of Appeals for the Federal Circuit denied Microsoft Corp.’s request for a rehearing en banc April 1, leaving a $290 million damages award intact and paving the way for a likely U.S. Supreme Court petition. A jury found that Microsoft Word infringed i4i LP’s patent on XML file handling, and Judge Leonard Davis upheld the jury’s award of $200 million, enhanced the damages by $40 million, and enjoined Microsoft from selling, using, or supporting versions of Word that are capable of opening XML files.
