On December 22, 2016, a California federal judge granted Finnegan client Patagonia Inc.'s request for a temporary restraining order against several companies selling knock-off versions of its vests. Patagonia sued Chelsea International, CAC International Group, and OTB Brand Worldwide (all under the same ownership) alleging trademark counterfeiting, trademark infringement, trademark dilution, copyright infringement, and unfair competition. The defendants claim they never saw the papers Patagonia served until two months later, despite the fact that the temporary restraining order filings were sitting on the front table of one of the defendants' locations.
