ITC Nixes GPS Probe After Honeywell-Pioneer Deal

January 8, 2010

Law360

The U.S. International Trade Commission has agreed to drop its investigation into a complaint by Honeywell International Inc. that Pioneer Corp. infringed four patents related to automobile GPS devices, following a settlement reached between the parties. As part of the settlement, Pioneer and Honeywell agreed to grant each other the right to use each company’s GPS patents. The deal resolves both Honeywell’s case against Pioneer and Pioneer’s own ITC complaint against Honeywell. Honeywell originally alleged that Pioneer was violating federal law by importing car navigation and display systems that infringe Honeywell patents. In late September 2009, an Administrative Law judge issued an initial determination holding that Pioneer’s importation of certain automotive multimedia display and navigation systems did not violate Section 337 of the 1930 Tariff Act. Pioneer launched its own complaint against Honeywell and Garmin Corp. in November over three patents for navigation technology, which the ITC agreed to investigate in early December. Pioneer is represented in this matter by Finnegan.
