Erik Puknys, managing partner of Finnegan’s Palo Alto office, was named for the third consecutive year, one of the top 75 IP litigators in California by the Daily Journal, California’s largest legal news provider. The profile article highlighted Puknys involvement in a case in the Northern District of California that was well underway when he came on board and had much of the record already established. The case involves eight patents and is scheduled for a jury trial. Also noted was a patent case he led involving environmentally-friendly refrigerant technology, which settled on favorable terms last year. Puknys noted that, “If you can settle the cases cheaply, it is better for everyone.” He also emphasized the importance of using a rational approach when it comes to damages assessments and pointed to a trend he is seeing at the U.S. Court of Appeals for the Federal Circuit "to make the law of damages more predictable.”
