Global IP 2016 Conclave & Awards

Jan./Feb. 2017

IP Era Magazine

During the 2016 Global Intellectual Property Conclave and Awards, organized by IP Era Magazine, Finnegan partners Anand K. Sharma and Philip L. Cupitt each moderated panel discussions. Sharma moderated the panel titled, "Patents: The U.S. Effect". He started off by asking the panelists why India is interested in U.S. patent litigation. Part of the reason is because the high number of verdicts in the U.S. that favor patent owners and award large damages amounts. He said, "Most countries will award reasonable royalty for patent infringement. In the U.S., you can get something called lost profits at significantly more than a royalty rate."

Cupitt moderated the panel titled, "BREXIT and Its Impact on IP Trends". Cupitt discussed the mood in the UK post-BREXIT. He said, "I think people are shocked and rather concerned for the future. But, the vote to leave EU is just the beginning of the story. There is a long and complicated process to go through before UK leaves if it leaves at all. The EU treaty contains a provision known as Article 50, which defines a formal mechanism for a country to leave the EU. It has never been used before so no one knows how effectively it is going to work in practice. What we do know is that the process of leaving the EU will take at least two years. I don’t think that the UK is going to leave the EU before 2019, it might even be 2020. But until that time, the UK is still very much part of the EU, and we are still subject to European law."
