About

Experience matters when strategizing appeals to the Board
The Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO) has the authority to hear and adjudicate appeals from applicants on adverse patentability decisions in patent applications and patent reissues and reexaminations. The appeal process is triggered by filing a Notice of Appeal, proceeds with a briefing of the issue(s) by applicant and examiner with an optional oral hearing, and then concludes with a written decision by the PTAB. Applicant’s written and oral advocacy is not only a key to a successful appeal, but also understanding when to seek an appeal in prosecution and further, keeping a watchful eye on enforcement issues. Finnegan attorneys understand the complexity and strategy involved. Our experience spans from appeals in a multitude of technical fields with varying issues of contention. We also appreciate the impact that an appeal can have on global patent portfolio along with its potential business implications. Argued on appeal at the Fourth Circuit that a trademark application for the design of Timberland’s classic 6-inch “Icon” boot should not have been refused by the Trademark Trial and Appeal Board (TTAB). The appeal is pending.

Ex parte Masashi Sekizaki, Satoshi Ishikawa and Kimihiro Matsuura
Argued on behalf of Yazaki Corporation on an ex parte appeal at the Patent Trial and Appeal Board (PTAB), obtaining a reversal of an examiner’s rejection of all claims in patent application related to a novel voltage monitoring device for an assembled battery.

Examiner's rejection reversed in favor of Finnegan client BrainScope
The Patent Trial and Appeal Board (PTAB) reversed a rejection of all patent claims in a patent application related to important neurodiagnostic device features for concussion and other brain abnormality assessments. Finnegan argued throughout the examination that the examiner had interpreted a claim limitation too broadly, and failed to appreciate the advance that the application claimed. After oral argument, the PTAB judges agreed and reversed the examiner's rejection on all grounds.
Inter partes reexamination ruling reversed in favor of Finnegan client Asetek
The Patent Trial and Appeal Board (PTAB) reversed a rejection of all patent claims in an inter partes reexamination filed against an Asetek patent related to pioneering computer cooling technology. Asetek previously asserted the patent in two separate district court litigations in the Northern District of California. Finnegan handled both cases, including one that went to a jury trial decision. Throughout the reexamination, Finnegan argued that the examiner had applied the wrong standard to interpret the claims, which resulted in an overly broad construction. The PTAB judges agreed and reversed the examiner on all issues, thus preserving the patent in full force.

Reissue proceedings at the USPTO leads to rejection reversal (Ex Parte Belliveau)
Finnegan represented patent applicant High End Systems Inc. in reissue proceedings before the U.S. Patent and Trademark Office Board of Patent Appeals and Interferences.  Finnegan was successful in obtaining a complete reversal of the Examiner’s rejection of claims to LED technology.
