Application and Claim Drafting: Leveraging the Basics

Today, it is no easy task to draft a patent specification and claims. Considering the case law, the various potential audiences (a district court judge, a Patent Trial and Appeal Board (PTAB) administrative law judge, a person of ordinary skill in the art, and/or a jury) and the complexity of the technology, prosecutors have their hands full.

Poorly drafted patents are now easily challenged at the U.S. Patent and Trademark Office (USPTO) in post-grant proceedings established by the America Invents Act (AIA). All too frequently, even patents that find their way into the courtroom are construed much more narrowly than the patentee may have intended or, worse, invalidated under the courts’ evolving interpretations of the statutory requirements for patentability. This webinar provides practical advice on how to draft a quality patent application with supporting claims by examining lessons learned from the case law and recent trends in post-grant proceedings.

Please join us for practical, real-world tips on things you can do during patent prosecution to maximize your chances of success in future litigation and USPTO post-grant proceedings. Topics will include: 

  • Claim strategies in light of recent case law regarding divided infringement 
  • Evolving patent eligibility standards for abstract ideas, laws of nature, and natural phenomena, and their impact on claim strategy 
  • Lessons learned about drafting claims to maximize the chance of surviving post-grant proceedings 
  • Building a prosecution history that can be used to defend the patent in a post-grant proceeding
