On January 25, 2016, a district court judge ruled in favor of Finnegan client Wisconsin Alumni Research Foundation (WARF), dismissing a case brought on by Washington University (WashU) which claimed WARF breached an inter-institutional agreement between the two parties. The agreement pertained to a patent for a treatment for conditions associated with kidney disease.
WARF moved for summary judgment and dismissal on the grounds that WashU’s claims were barred by the applicable statute of limitations. The judge dismissed the case, finding no evidence of inequitable, unfair, or misleading conduct on the part of WARF, and that all claims were time-barred by the applicable statutes of limitations.
