The Federal Circuit affirmed a lower court’s summary judgment on Tuesday, August 27, finding in favor of Finnegan client Covidien that “a patent on a laparoscopic surgery device allowing lateral movement cannot be infringed under the doctrine of equivalents by a device with an assembly that rotates but does not shift from side to side.” Finnegan represented Covidien in this matter.
