On-Net Surveillance Systems, Inc.
Danish company Milestone Systems A/S (Milestone), a global leader in IP video management software and surveillance solutions, entered into an agreement with U.S.-based On-Net Surveillance Systems Inc. (OnSSI), allowing for the incorporation of Milestone’s software components in OnSSI’s own video management system. Based on OnSSI's subsequent breaches of the agreement, Milestone initiated an arbitration proceeding before the Danish Institute of Arbitration (DIA), which unanimously found in favor of Milestone and awarded damages and costs, as well as running interest. In parallel with the arbitration, OnSSI filed a suit against Milestone in the Southern District of New York, alleging a variety of contractual and business tort claims. Milestone, represented by Finnegan, successfully secured a dismissal in the early pleadings stage of the case. When no payment was received following the arbitration, Milestone (again represented by Finnegan) filed a petition in the Southern District of New York seeking to confirm the arbitration awards and enforce the ordered non-monetary relief against OnSSI. Upon Milestone receiving the required payment, the parties asked the court to issue a consent order barring OnSSI from distributing or integrating Milestone’s software in the United States, which the court granted, resulting in a complete victory for our client.
