Kaitlyn Pehrson focuses on patent and trade secret litigation as well as post-grant proceedings related to chemicals, pharmaceuticals, gene therapy treatments, medical devices, and energy technology. She represents clients in litigation proceedings in district courts and before the U.S. Court of Appeals for the Federal Circuit and the International Trade Commission (ITC).
Kaitlyn is a registered patent attorney with experience in all stages of litigation, including pre-litigation research and strategy; all phases of discovery, motion practice; preparing witnesses for trial; taking and defending depositions; and arguing matters in court. She manages day-to-day litigation activities and has key responsibilities in all aspects of proceedings, from the initial pleading stage through discovery, motions, claim construction, and trial. Kaitlyn also provides strategic guidance to clients on infringement, validity, as well as enforceability issues and has extensive experience with remedies and injunctive relief.
Kaitlyn’s experience includes representing innovators in complex, multi-defendant litigations involving treatments for complex medical conditions. The cases were against both individual defendants and corporations. Kaitlyn has assisted in several branded Hatch-Waxman and Biologics Price Competition and Innovation Act (BPCIA) litigations at the district court and Federal Circuit levels. She manages extensive discovery with accelerated case schedules and contentious defendants and navigates state and federal law, analyzing the impact of those differences on choice of venue and forum, what claims can be brought, and what remedies may be available. Katilyn counsels clients on case dispositive motions, including motions to dismiss trade secret and related claims, and has successfully opposed such motions.
Prior to law school, Kaitlyn worked as an engineer in several technology fields, including roles where she handled medical devices, copper mining and extraction, and consumer goods. She applies her chemical engineering background and practical insights in protecting clients’ innovations across a wide range of chemical and life science technologies. She understands the details of processes and products related to these industries as well as the research and development required to commercialize them. Kaitlyn has experience as a process engineer monitoring, troubleshooting, and optimizing manufacturing processes in addition to experience as a research and development engineer developing processes and formulations.
Kaitlyn is committed to her pro bono practice. She has represented disabled military veterans before the U.S. Court of Appeals for Veterans Claims and the Federal Circuit in cases related to denial of benefits. Kaitlyn has been recognized on the Capital Pro Bono Honor Roll. Before joining the firm, she spent several months volunteering her legal services at the National Veterans Legal Services Program (NVLSP).

Represented Rocket Pharmaceuticals, Inc. in district court litigation involving claims of trade secret misappropriation and breach of contract against individual and corporate defendants and relating to complex treatments for genetic disorders. Successfully opposed motion to dismiss key claims and obtained settlement with all defendants following completion of fact discovery.

Represented Sarepta Therapeutics, Inc. and its licensor The University of Western Australia in patent litigation relating to nucleic acid therapies for treatment of Duchenne muscular dystrophy (DMD). A federal jury in the District of Delaware awarded Sarepta Therapeutics over $115 million in its patent infringement case against Nippon Shinyaku Co. Ltd. This substantial verdict upholds the validity of Sarepta's groundbreaking exon-skipping treatment, and the underlying work at the University of Western Australia.
