Finnegan served as lead counsel for the Cosentino entities in multiple district court cases brought by a competitor in the fast-moving Western District of Texas. The cases involved popular colors of Cosentino’s Silestone products used for countertops, tabletops, and floors. The Finnegan team successfully argued against a motion for preliminary injunction that sought to stop all U.S. sales of the accused Silestone products.
Finnegan filed inter partes reviews (IPRs) and post-grant reviews (PGRs) challenging the five patents asserted against Cosentino, each within a month of assertion. The Patent Trial and Appeal Board (PTAB) instituted each validity challenge on which it ruled. Finnegan also filed a suit against the competitor, alleging infringement of a Cosentino patent.
After the district court set an aggressive trial schedule, Finnegan pursued discovery that enabled resolution of the lawsuits. The parties ultimately settled their dispute, leaving the U.S. market open to Cosentino’s industry-leading Silestone products.
