Synergistic and Surprisingly Effective: Inventive Step and Non-obviousness in Chemical and Life Sciences Cases

The answer to the question “But, is it obvious?” is of fundamental importance to the validity of Chemical and Life Sciences patents. In this seminar we will consider how this question is answered in the United States and in Europe. We will discuss how to obtain patents that have the best chance of surviving obviousness challenges.  

Topics to be discussed include:

• Can you use the same approach to establish inventive step before the EPO and non-obviousness before the USPTO?  And how about before the courts in Europe and in the United States?
• The skilled person – who are they and what do they know?
• Experimental data – how can it be used in support of inventive step/ non-obviousness?
