The U.S. International Trade Commission's (ITC) Section 337 investigations have long been a major battleground for intellectual property disputes in the high-tech industry. The UPC (United European Patent Court), a new European patent litigation system, presents unprecedented challenges for businesses. To help companies manage risks and seize opportunities in complex cross-border intellectual property litigation, please join the seminar on November 4 in Beijing and November 7 in Shanghai.

The lecture will delve into two major intellectual property enforcement mechanisms in Europe and the United States. Mareesa Frederick, partner and former Senior Investigations Attorney and Chief Government Advisor at the ITC, and Dr. Antje Brambrink, Leading Attorney at IAM Strategy 300, will systematically outline:

  • Common reasons for triggering Section 337 investigations for companies
  • Recent major Section 337 cases involving Chinese companies
  • Section 337 investigation procedures and winning strategies; How Chinese companies can proactively utilize Section 337 investigations
  • How the UPC is changing the European patent protection landscape; Key procedural interpretations
  • How the UPC exercises its long-arm jurisdiction based on the latest ruling in the European Court of Justice case BSH v. Electrolux (C-339/22)
  • Best practical advice for Chinese companies dealing with UPC litigation

This lecture aims to provide practical guidance for corporate legal, intellectual property, and management teams, helping companies build a robust intellectual property defense line when expanding overseas.
