Please join us for a discussion of antibody patent prosecution, enforcement, and defense; case law and regulatory updates impacting biosimilar and pharmaceutical products; and recent decisions involving patent-eligible subject matter. Specifically, we will address:

  • Antibody patenting in the era of biosimilars, including the shrinking “antibody exception” and how to overcome resistance to such claims, and strategies for expanding the scope of protection
  • Recent developments surrounding the Biologics Price Competition and Innovation Act (BPCIA), including recent case law developments, FDA draft guidance for demonstrating biosimilar interchangeability with a reference product, and the intersection with post-grant proceedings before the United States Patent and Trademark Office (USPTO)
  • The latest update on Section 101 subject matter eligibility in the life sciences
  • Listing patents in the Orange Book: How, when, and why, including the FDA’s new rules and procedures
