Typically, in patent infringement proceedings the plaintiff has the burden of proof and must therefore show that all features of the asserted claims are realized by the accused product or method. The challenge is often obtaining the evidence necessary to meet the required burden while utilizing the tools available in the relevant jurisdiction. In no small part because the tools and scope of discovery and the measure for preserving evidence vary significantly from jurisdiction to jurisdiction.
