Europe’s Unified Patent Court (UPC) will open for business in 2023. This will provide litigants with the option to pursue patent actions involving multiple European jurisdictions in a single proceeding, rather than having to bring multiple actions, as now is the case. Strategic considerations will apply to the choice of which division of the UPC to initiate a court action or whether to initiate national actions in the national courts.
