Since the Supreme Court’s 2006 decision in eBay v. MercExchange, many patent practitioners have considered preliminary or permanent injunctions nearly impossible. But recent Federal Circuit and district court decisions show that injunctions for patent infringement, especially between competitors, are still available. In this webinar, we will discuss eBay and its impact on manufacturers, the Federal Circuit’s decisions in the Apple v. Samsung battle, and the current state of the law regarding injunctions. We will also highlight several recent cases dealing with injunctions between competing manufacturers and discuss why the court granted or denied the injunction.

Join us as we discuss:

  • The factors for preliminary and permanent injunctions;
  • The proofs necessary to establish irreparable harm from a competitor’s infringement; and
  • The interplay between reasonable royalties, lost profits, and injunctive relief.
