Finnegan's client Volkswagen Group of America Inc. convinced the Patent Trial and Appeal Board (PTAB) to review a semiconductor patent that is currently under a separate infringement investigation at the International Trade Commission (ITC). Despite the PTAB being reluctant to conduct review on a patent already under ITC investigation, the Board concluded that, in the petition for review, Volkswagen challenged several claims that aren’t included in the ITC investigation.
