The Unified Patent Court (UPC) opened its doors on June 1, 2023 after decades of planning. The court promises litigants the ability to resolve disputes across several European Member States within a short time frame. The new Court is gaining more and more traction and many cases have already been filed. Law360 has highlighted important cases to watch in the coming months.
Speaking on Amgen v. Sanofi, Finnegan partner Antje Brambrink said, "It was widely predicted that the pharmaceutical industry would be reluctant to bring cases before the new court given the risk of a central revocation attack against the patent-in-suit. It was therefore quite a surprise that this case was one of the first to be filed with the UPC."
