Finnegan client Volkswagen secured a ruling from Judge Lee H. Rosenthal of the Southern District of Texas, who deemed VDPP LLC's case exceptional and ordered VDPP and its counsel, Ramey LLP, to pay Volkswagen's attorney fees. The court found VDPP and Ramey LLP liable for "repeated misconduct," including seeking relief for a patent that had expired a year prior and failing to allege proper patent marking.
