In a win for Finnegan client Volkswagen Group of America Inc., a Texas federal judge has ordered VDPP LLC and its counsel, Texas attorney William Ramey III, to pay $207,543 in legal fees after a "frivolous" patent lawsuit was dismissed. U.S. District Judge Lee H. Rosenthal found the case to be without merit from the outset and described the litigation as "sloppy" and "offensive." Judge Rosenthal emphasized that the entire case was exceptional, warranting the full fee award to Volkswagen's counsel. Despite VDPP's attempt to limit the fees to certain aspects of the case, the court rejected this argument, ruling that VDPP's misconduct had "infected the entire litigation."
