On January 29, The Internet Corporation for Assigned Names and Numbers (ICANN) began releasing new generic top-level domains (gTLDs). Finnegan attorney Marina A. Lewis spoke with Corporate Counsel about the launch and why business and brand owners—including those with an established .com—should follow the development. ICANN has registration options for brand owners seeking to protect their IP rights from cybersquatting via the Trademark Clearinghouse (TMCH). Lewis explained the TMCH has mechanisms in place where if a company attempts to register a verified trademark, “they will be on notice, and that protects the brand owner.” Adding, “The owner of a trademark can show that the company knew it would be infringing, it was put on notice and it acted anyway.”
