On December 10, 2018 the U.S. Supreme Court upheld a Federal Circuit decision in favor of Finnegan client PPC Broadband, denying Corning Optical Communications' petition for certiorari. The Federal Circuit's decision affirmed a lower court's $61 million award of enhanced damages against Corning after PPC Broadband accused the company of infringing patents on coaxial cable connectors. Corning argued that the judgment was based on a misreading of the Supreme Court's Halo decision.
Finnegan partner Mike Jakes represented PPC Broadband. He said, "With the Supreme Court’s decision today, this closes the final chapter on this long-running patent case, which lasted over seven years. It shows how the patent system can protect patent owners like PPC from copyists when they are willing to see a case through to the end."
