High Court Won’t Review Obviousness Test in DuPont IP Row

On October 3, 2016, the Supreme Court rejected MacDermid Printing Solutions' petition asking the high court to review a Federal Circuit decision that ruled in favor of Finnegan client DuPont.

On March 16, 2016, the Federal Circuit affirmed a Patent Trial and Appeal Board (PTAB) decision validating claims of DuPont Co.’s patent for thermal flexographic plates in an infringement suit brought by MacDermid. MacDermid had appealed the PTAB’s decision, arguing that the Board erred in its construction of the terms "cooling means" in DuPont’s patent. However, the Federal Circuit refused to overturn the PTAB’s decision validating the claims.
