Finnegan client, Castle Retail, will keep the attorneys’ fees it was awarded after beating a patent lawsuit. Hawk Technology claimed Castle’s security system violated its patent, but courts ruled Hawk’s patent was weak and based on an abstract idea. The case was labeled “exceptional” because Hawk filed many frivolous lawsuits, acted unprofessionally during settlement talks, and submitted a vague complaint. The Federal Circuit upheld the fee award and also ordered Hawk to pay court costs.
