Fed. Circ. Rejects Microsoft’s En Banc Bid Against i4i

April 1, 2010

Law360

A federal appellate court has rejected Microsoft Corp.’s request for a full panel of judges to rehear en banc its appeal in a long-running document formatting-patent lawsuit that resulted in a landmark $290 million award for opponent i4i LP. The appeals court found that a jury had been right to find that the patent was valid and that Microsoft willfully infringed it. I4i’s patent covers a software-controlling document system that relies on the XML custom formatting function and enables individuals to manipulate electronic documents without using manually embedded code. Toronto-based i4i is represented by Finnegan.
