On April 20, 2020, the U.S. Court of Appeals for the Federal Circuit ruled in favor of Finnegan client WCM Industries Inc., upholding a district court judge’s decision to multiply WCM’s win against IPS Corp. for infringing its patents for bathtub drain fixtures. In 2013, WCM accused IPS of infringing the patents. Jurors found that IPS willfully infringed three WCM patents and awarded WCM $1.38 million. The judge trebled the amount, which came out to be just more than $4.15 million. On appeal, the Federal Circuit said the judge did not properly justify trebling the damages and remanded the case. The judge conducted a second analysis, which the Federal Circuit found to be sufficient.
