The Eastern District of Virginia ruled in favor of Finnegan client Maglula, denying Amazon’s attempts to dismiss a trademark infringement suit revolving around the sale of counterfeit pistol mag loaders. Maglula discovered numerous counterfeit versions of its UpLULA product on Amazon’s website and despite Maglula’s three-year attempt to pressure Amazon to take action to prevent the infringement, Amazon failed to do so. The court sided with Maglula, denying Amazon’s motions to dismiss, transfer venue, and compel arbitration.
