Eric Fues focuses on patent and trade secret litigation in U.S. district courts and at the U.S. International Trade Commission (ITC). With over 30 years of litigation experience, he has served as lead counsel in a variety of high-stakes intellectual property disputes in federal court, state court, at the ITC, and on appeal to the U.S. Court of Appeals for the Federal Circuit. He also has significant experience with pharmaceutical patent litigation under the Hatch-Waxman Act, and in inter partes review (IPR) proceedings before the Patent Trial and Appeal Board (PTAB) at the U.S. Patent and Trademark Office (USPTO).
Eric has broad experience in all aspects of litigation, including examining witnesses at trial, arguing motions in court, and managing day-to-day litigation activities. While his cases involve a wide array of technologies, he focuses primarily on the fields of pharmaceuticals, agricultural chemicals, polymers, semiconductor devices and processing, light-emitting diodes (LEDs), digital imaging, and vehicle navigation systems. Prior to his legal career, Eric worked as a management consultant for a variety of business clients, and as a semiconductor engineer at Texas Instruments.
In addition to his litigation practice, Eric advises clients regarding patent licensing issues, pre-litigation due diligence, and patent enforcement strategies. He has been recognized by The Legal 500 U.S. for trade secrets work, and by Intellectual Asset Management (IAM) as a leading patent litigator in the D.C. area as well as for his ITC practice. Eric has served as president of the ITC Trial Lawyers Association (ITCTLA), and as leader of Finnegan’s chemical and metallurgical practice.
Eric’s pro bono activities include representing military veterans before the U.S. Court of Appeals for Veterans Claims and the Army Board for Correction of Military Records.

As part of a global dispute concerning LED technology that encompassed litigations in the United States, Germany, South Korea, Japan, and China, Finnegan represented LG Electronics and LG Innotek against OSRAM AG in three separate investigations before the ITC and in two related U.S. district court proceedings. All three ITC investigations proceeded to trial, and a final initial determination issued in one proceeding, which the Commission determined to review. The parties, however, reached a global settlement resolving all disputes worldwide before the Commission issued any final decisions and before any trial in the U.S. district courts. Based on public press releases from both parties, LG and OSRAM are pleased to have reached agreement.
