The past year has proven eventful for patent stakeholders in the United States. The U.S. Supreme Court, the Court of Appeals for the Federal Circuit (CAFC), and the USPTO’s Patent Trial and Appeal Board (PTAB) issued key decisions impacting U.S. patent rights. Join us as we cover these important decisions and discuss their practical applications, including in the following areas:

  • Patent Eligibility – The CAFC’s decision in Ariosa v. Sequenom and post-Alice decisions concerning computer-implemented inventions.
  • Indefiniteness – The “law of indefiniteness” under the U.S. Supreme Court’s Nautilus decision and the CAFC’s decision in Williamson v. Citrix.
  • Enablement – The CAFC’s decision in Allergan v. Sandoz.
  • Claim Construction – The PTAB’s BRI standard under In re Cuozzo and the standard for reviewing claim constructions under the U.S. Supreme Court’s Teva v. Sandoz decision.
  • Infringement – Defenses to inducement under the U.S. Supreme Court’s Commil v. Cisco decision and divided infringement under the CAFC’s Akamai v. Limelight decision.
