Eric Raciti has more than 25 years of experience advising companies as a trusted advisor on intellectual property matters. He received his formational training in industrial systems engineering, learning the importance of a multidisciplinary approach that includes a marriage of technology and business processes. His training and experience taught him the value of communicating clearly with management, legal, financial, and technical professionals.

Eric’s extensive background in IP law includes patent portfolio development, intellectual property enforcement, technology counseling, strategic commercialization strategies, corporate IP policy, technology acquisitions, risk mitigation and due diligence for fund-raising and investment rounds. Based in Boston, his experience with large corporate environments as well as conception-stage startups has given him broad perspective over a range of intellectual property issues, and allows him to find pragmatic and creative solutions to complex problems, as well as the efficient realization of client goals.

A frequent speaker on intellectual property matters, Eric has delivered dozens of seminars across North America and Europe on a wide range of topics to audiences of lawyers, business managers and engineers.

As a young lawyer before joining Finnegan, Eric worked at prominent Boston general practice firms, learning the role of intellectual property in a general corporate practice, focusing on licensing, transactions, and mergers and acquisitions. Earlier in his career, Eric worked as a patent examiner for five years at the U.S. Patent and Trademark Office in the field of medical devices, and later, after earning his masters of laws degree, for the commissioner of patents in the Office of Legislative and International Affairs. Eric served as an adjunct professor at the University of New Hampshire Franklin Pierce School of Law, where he taught a course on technology licensing.

Eric was selected as one of the Top 100 Clean Technology and Renewable Energy Attorneys by LMG Clean Technology and Renewable Energy and recognized by Intellectual Asset Management (IAM) for his practice in Massachusetts.

Experience

OrthoAccel Technologies, Inc. v. Propel Orthodontics LLC

Successfully represented Propel in defending against a preliminary injunction action filed by a competitor for patent infringement on orthodontic devices. The court denied any of the relief requested by the patentee, finding that their asserted patent is likely invalid. On appeal, the Federal Circuit affirmed the district court’s decision.

Helped a global chemical company conduct due diligence when acquiring intellectual property rights in nanotechnology

Oversaw due diligence for one of the world’s largest chemical companies during the acquisition of another company, including overseeing the mapping and analysis of the target’s patent portfolio and analyzing potential infringement by competitors.

Full intellectual property service for a healthcare client developing wireless communication systems

A leading healthcare company that develops wireless communication systems for managing patient care turns to Finnegan for counsel in many different facets of intellectual property (IP). We study the patent landscape for wireless health management and assist the company in weaving its way through patents of its competitors; we obtain patent protection for its technology and trademark protection for its brands; and we provide guidance in drafting agreements for the transfer of technology.

Strategic intellectual property management for a client investigating nanotechnology

One of our long-standing clients asked us for advice on how to expand its patent portfolio to include nanotechnology. We researched the activities of its competitors, reported our findings, and suggested a course of action to a group of its senior intellectual property (IP) counsel and technical leaders. Our report focused on the implications of nanotechnology in the client’s industry and identified desirable avenues of research and product development where nanotechnology could be implemented and protected to provide an advantage in the marketplace.

Global patent analysis for renewable energy

A European company asked us to conduct intellectual property (IP) due diligence on a technology it was looking to acquire. The renewable energy focused on the production of photovoltaic cells. In less than one month, we coordinated prior art searches in Europe and the U.S., evaluated the search results containing over 500 U.S. and European patents, provided our opinion on freedom to operate with the target technology, and set up a system to monitor European and U.S. patents that may be granted in the future.

Top-level global management of licensed and native neuromodulation intellectual property

Finnegan was selected to supervise the identification and development of native intellectual property (IP) and the oversight of the licensed IP of numerous academic partners in the U.S. and Europe.  As an ongoing exercise, the company’s portfolio is landscaped in the context of the industry for business, legal and research and development (R&D) decisionmakers.  Identification of acquisition candidates and targets for both in- and out-licensing is based on current information from these activities. New product development risks are also mitigated by leveraging an up-to-date understanding of competitors’ IP positions.
