Pace and Progress: Strategies for Cost-Effective Control of Global Patent Prosecution

Not all patent applications are of equal value, and priorities can change during prosecution. Please join us as we discuss what can be done to take control of the pace and progress of proceedings. We will review the options, advantages, and risks for expediting or delaying patent prosecution in the major global patent offices and the typical reasons for accelerating or delaying examination, including the benefits and downsides of either strategy. We will also consider strategies for ensuring the cost-effective coordination of global portfolios, taking differing priorities into account. Discussion topics include:

  • Global filing strategies
  • Accelerated prosecution under the PACE system in Europe
  • New timelines for EPO prosecution and oppositions
  • Track One prioritized examination and options for deferring examination in the United States
  • Impact of accelerated or delayed examination on U.S. patent term extension (PTE) and patent term adjustment (PTA)
  • Double patenting and other portfolio-level strategic considerations for accelerated or delayed examination
  • Patent Prosecution Highway (PPH) – When and where is it worth using?
  • Use of Examiner Interviews
  • Influencing the progress of your competitors' applications in Europe and the U.S.
