Post-grant proceedings have quickly become one of the most popular tools for challenging the validity of a patent while maintaining low costs. But navigating the law of this new arena can be challenging. With the small body of PTAB decisions starting to grow, now is the time to identify key strategies that have proven useful, as well as areas where favorable precedent can still be set.
