WiLAN Patent Trial Against Ericsson Canceled

On May 15, 2015, a Florida federal judge canceled a patent infringement trial against Finnegan client Sony Mobile Communications and Ericsson, indicating that he intends to issue an order on Ericsson’s motion for summary judgment. The trial was scheduled to begin on May 26, 2015.

In 2006, WiLAN Inc. accused Sony and Ericsson of infringing four wireless patents. The companies reached an agreement in 2008 that granted Ericsson certain rights, but the case was then appealed to the Federal Circuit to determine the scope of those rights. After a licensing agreement was reached, WiLAN then sued Sony and Ericsson in Florida over three more patents. In its motion for summary judgment, Ericsson asked the court to declare that it did not infringe on two of the patents.
