Supreme Court Won't Hear Appeal of $46M Limelight Verdict

April 18, 2016

Law360

On April 18, 2016, the Supreme Court ruled that it will not review the Federal Circuit's decision to reinstate a $45M jury verdict in favor of Finnegan client Akamai.

On November 16, 2015, the Federal Circuit ordered a district court judge to reinstate a $45M jury verdict that Limelight Networks infringed Akamai Technologies Inc.’s web content delivery patent. After the August en banc ruling that determined Limelight was liable for infringing, the en banc court sent the case back to the panel to consider Limelight’s alternative arguments for overturning the jury verdict; the panel rejected all of Limelight’s alternative arguments. Limelight later filed a petition for review before the U.S. Supreme Court, which was denied.
