On March 24, 2011, Judge Jan E. Dubois of the U.S. District Court for the Eastern District of Pennsylvania “approved a final judgment that SAP AG does not infringe ElCommerce.com Inc.’s patent for supply chain management based on the court’s claim construction order." Additionally, the decision “also dismissed without prejudice SAP’s counterclaims and defenses not specifically addressed in the court’s previous ruling, which permits SAP to renew those allegations should an appeal result in remand and reversal.” Finnegan represents SAP in this matter.
