On August 28, the Federal Circuit ruled in favor of Finnegan client NOVA Chemical Corp., finding Dow Chemical Co.’s patent claims to be invalid for indefiniteness in light of the Supreme Court’s Nautilus decision. The ruling also reversed an award of supplemental damages in excess of $30 million.
