On Thursday, January 17, the Federal Circuit ruled that “a lower court had relied on a faulty claim construction when it found that Federal Express Corp. had willfully infringed several Harris Corp. patents covering technology for transmitting flight information stored in an airplane’s ‘black box.’” In the 2-1 panel decision, the Federal Circuit ordered the lower court to use FedEx’s proposed claim construction on remand. Finnegan represented FedEx in this matter.
