Crotty found U.S. Patent Number 7,846,442 invalid for “obviousness-type double patenting.” The ’442 patent, held by the Mathilda and Terence Kennedy Institute of Rheumatology Trust, allegedly covered the anti-inflammatory drug Humira®.
