Survival of the Fittest: Preparing and Prosecuting Manufacturing Patents for the PTAB and UPC

Manufacturers typically have common goals in mind when preparing a patent application: securing enforceable, valid, and commercially valuable protection for their processes and products. Differences in international patent laws and practice make preparing an international patent application challenging. Recent changes in validity proceedings in both Europe and the United States are compounding the challenge. In the United States, the Patent Trial and Appeal Board (PTAB) changed the landscape of post-grant validity challenges. In Europe, change is on the horizon, with the Unitary Patent and Unified Patent Court (UPC) expected to come into force early next year.
