In 2014, the Supreme Court’s Nautilus decision shined the spotlight back on the definiteness requirement for patent claims and also changed the standard for indefiniteness from “insolubly ambiguous” to “reasonable certainty.”

While the impact of this new standard is debatable, it is nonetheless a consideration in application and claim drafting. Please join us for a practical discussion on topics that include:

  • Nautilus Deconstructed: What Is the New Standard
  • The Law of Indefiniteness: Post-Nautilus Decisions
  • Functional Claiming: Where, When, and How
  • Prosecution Strategies and Considerations
