The requirements for inventive step in Europe and non-obviousness in the United States have many similarities but also some subtle differences. The challenges faced by different technologies can also vary for inventive step and obviousness. In most cases, you might expect to use similar tactics and obtain similar results, but some cases require different approaches and can end up with very different outcomes. With global patenting strategies, companies often struggle to ensure consistency when prosecuting applications to grant in both jurisdictions and within different technologies.
Following on Finnegan’s inventive step vs. obviousness webinar from earlier this year, which gave an overview of both proceedings, this sequel will focus on industry and technology specific examples and practical advice.
