Post-grant proceedings have quickly become one of the most popular tools for challenging the validity of a patent while maintaining low costs. But navigating the law of this new arena can be challenging. With the small body of PTAB decisions starting to grow, now is the time to identify key strategies that have proven useful, as well as areas where favorable precedent can still be set.
With significant experience in some of the first post-grant proceedings, this panel will help you navigate the phases of these proceedings, from petition for review to the oral hearing. Each stage of the process offers opportunities and landmines for both the patent owner and the petitioner. We will help you identify these issues before the first petition is even filed.
