This article discusses Nautlis v. Biosig, a case before the U.S. Supreme Court concerning indefiniteness grounds in patent invalidity claims. Finnegan partner James R. Barney provided commentary on the potential impact of the case. “I think the most likely outcome is going to be along the lines of a tweak but even a tweak is going to be an important event,” Barney said. “Just because a patent claim is broad does not mean it is indefinite.”
