On July 6, 2015, the Federal Circuit upheld a North Carolina federal court decision dismissing Celgard LLC’s patent infringement suit against Finnegan client SK Innovation. Celgard is a manufacturer of battery membranes that are used to separate chemical cell components in lithium-ion batteries in cars and electronic devices. The company alleged SK Innovation infringed its patent covering these chemical separators. The Federal Circuit tossed the suit for lack of jurisdiction, concluding that SK Innovation had minimal connection to the state of North Carolina, and that the sale of products and devices in North Carolina that use the alleged infringing product is not enough to establish jurisdiction in the state.
